Overview

Welcome to lumepick. In these Terms, “we,” “us,” and “our” mean LumePick LLC, which operates the lumepick store at lumepick.vip.

The site, product pages, checkout, accounts, and related features we offer through that store are the “Services.”

The store runs on Shopify’s ecommerce platform.

These Terms, together with the other policies posted on the site, set out the rules that apply when you visit or use the Services.

Read them before you browse, create an account, or place an order. They describe your responsibilities and include limits on warranties and liability.

By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

Section 1 — Access and Account

You represent that you are of legal age in the place where you live.

To shop, open an account, or complete a purchase, you may need to give us an email address, billing information, payment details, a phone number, and a shipping address.

You confirm that the information you submit is accurate, up to date, and complete, and that you are allowed to provide it.

Keep your login details confidential. You are responsible for activity that occurs under your account. You may not sell, assign, or lend the account to anyone else.

Section 2 — Our Products

We try to describe products fairly. Color, material, size, finish, texture, packaging, and overall look can still differ from what you see on a screen because of photos, lighting, manufacturing variation, device type, and display settings.

We do not promise that a product’s look, color, size, fit, performance, assembly, installation, or quality will match the listing in every respect or match what you expected.

Measurements and specs are approximate unless the listing says otherwise. How a product performs can depend on the room, surface, wiring, climate, assembly, installation, upkeep, and how it is used.

Descriptions, specs, prices, and stock may change without notice. We may stop offering an item or limit how many we sell to a person, household, or area where the law allows.

Section 3 — Orders

Submitting an order is an offer to buy. LumePick LLC may accept, refuse, limit, or cancel an order where the law allows.

An order is accepted only after payment goes through and we confirm it.

Check the order before you submit it. We may not be able to change or cancel it once processing has started.

If we refuse, change, or cancel an order, we may reach you at the email, billing address, shipping address, or phone number given with the order.

Sales are also subject to our Refund & Return Policy.

Products are sold for personal or household use unless we agree otherwise in writing. Unauthorized resale or export is not allowed.

Section 4 — Prices, Taxes, and Billing

Prices and promotions can change without notice. The amount charged is generally the amount shown when the order is confirmed, except that we may correct clear errors where the law allows.

Taxes, shipping, handling, and other charges may apply as shown at checkout or as required by law.

You agree to keep billing, payment, and account information current so we can complete the sale and contact you.

Section 5 — Shipping and Delivery

Delivery dates are estimates only.

We are not responsible for delays caused by carriers, weather, holidays, a wrong or incomplete address, carrier outages, security or customs checks, supply problems, remote locations, or other events outside our reasonable control.

Risk of loss passes as provided by applicable law.

Section 6 — Intellectual Property

The Services—including names, marks, text, photos, graphics, video, audio, layouts, and other content—are owned by, licensed to, or lawfully used by LumePick LLC or its licensors.

You may use the Services for your own personal, non-commercial shopping.

You may not copy, distribute, alter, display, republish, scrape, store, or commercially use site content without our written permission, except as the law allows.

lumepick names, logos, product names, and slogans are identifiers of LumePick LLC or its licensors. Shopify’s names and marks belong to Shopify.

Section 7 — Optional Third-Party Tools

We may point you to tools or services run by other companies. We do not operate or supervise those tools.

They are offered “as is” and “as available,” without a warranty or endorsement from us.

If you use them, you do so at your own choice and may be bound by the third party’s terms.

Section 8 — Third-Party Links

The site may link to pages we do not run.

We do not control those sites and are not responsible for their content, security, products, privacy practices, or terms.

Read the other site’s policies before you share information or buy anything there.

Section 9 — Relationship with Shopify

Shopify supplies the platform that hosts lumepick.

A purchase on the store is a contract between you and LumePick LLC, not Shopify.

To the extent the law allows, Shopify is not responsible for the products, fulfillment, or purchase disputes.

Section 10 — Privacy

Personal information collected on the site is handled under our Privacy Policy and, where relevant, Shopify’s privacy materials.

Section 11 — Reviews and Feedback

If you send reviews, photos, videos, ideas, or other content, you confirm that you have the right to submit it.

You grant LumePick LLC a worldwide, non-exclusive, sublicensable, royalty-free license to use, copy, adapt, publish, and display that content for store operations, customer service, and marketing, as allowed by law.

Do not submit content that infringes someone else’s rights, breaks the law, or misleads shoppers.

Section 12 — Errors, Inaccuracies, and Omissions

Listings may contain mistakes in descriptions, specs, prices, promotions, shipping charges, delivery estimates, or availability.

We may fix errors and update information at any time. Where the law allows, we may cancel an affected order and refund it.

Section 13 — Prohibited Uses

You may not use the Services:

For illegal, fraudulent, abusive, or harmful activity.
To violate intellectual-property, privacy, contract, or other rights.
To introduce malware or other harmful code.
To disrupt the site, its security, or access controls.
To scrape, crawl, copy, or automate access without permission.
To collect other people’s personal information unlawfully.
To spam, phish, impersonate anyone, or hide your identity.
To copy or exploit the Services for unauthorized commercial use.

We may suspend or close access if we reasonably believe these Terms were broken.

Section 14 — Termination

We may suspend or end access to the Services where the law allows.

You still owe amounts that came due before termination. Clauses that naturally survive—such as intellectual property, limits on liability, indemnification, governing law, and privacy—remain in effect.

Section 15 — Disclaimer of Warranties

To the maximum extent the law allows, the Services and products are provided “as is” and “as available,” unless a written warranty says otherwise.

We do not promise that the site will always be available, timely, secure, complete, accurate, or free of errors.

Nothing in these Terms removes consumer rights or warranties that the law does not allow us to remove.

Section 16 — Limitation of Liability

To the maximum extent the law allows, LumePick LLC and its owners, officers, employees, contractors, agents, providers, licensors, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

That includes lost profits, revenue, savings, data, opportunity, goodwill, or replacement costs connected with use of the Services or products.

Nothing in these Terms limits liability that cannot legally be limited.

Section 17 — Product Assembly, Installation, and Use

Some items, including wall lights and other fixtures, may need assembly, mounting, electrical work, tools, a suitable surface, compatible wiring, or a licensed installer.

You are responsible for reading the instructions, confirming the product is suitable for your space, following safety warnings, and using the item only as intended.

If a professional should install or repair the product, or if the law requires it, hire a qualified person.

LumePick LLC is not responsible for damage from incorrect assembly, installation, measurements, alteration, misuse, an unsuitable surface, incompatible wiring, poor maintenance, or ignored instructions, except where the law says otherwise.

Section 18 — Indemnification

To the extent the law allows, you agree to defend and hold harmless LumePick LLC, Shopify, and their affiliates, officers, employees, agents, contractors, licensors, and providers against claims, losses, damages, and reasonable legal fees that arise from your unlawful use of the Services, your breach of these Terms, or your violation of someone else’s rights.

Section 19 — Severability

If a court finds any part of these Terms unenforceable, that part will be applied as far as the law allows, and the rest of the Terms will remain in force.

Section 20 — Waiver and Entire Agreement

If we do not enforce a clause on one occasion, we may still enforce it later.

These Terms and the policies on lumepick.vip are the agreement that governs use of the Services, unless a separate written contract applies.

Section 21 — Assignment

You may not assign these Terms without our written consent.

We may assign them in connection with a sale, merger, financing, or other business transfer, or as otherwise allowed by law.

Section 22 — Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without reducing any mandatory consumer protections that apply in the place where you live.

Section 23 — Headings

Section titles are for convenience only and do not change the meaning of the Terms.

Section 24 — Changes to These Terms

We may post an updated version of these Terms on the site.

Continued use after an update is acceptance where the law allows. An update will not take away mandatory rights that already apply to an order you placed.
